Investment Risks Disclosure

Investing in securities involves risk of loss that an investor should be prepared to bear. An investor in any of the strategies managed by SMS Investing® must understand and be willing to accept those risks, including the loss of a significant amount of any such investment in securities. Those risks include the risk of changes in economic and market conditions, the concentration of investments within a portfolio, and the volatility of securities. Obtain a prospectus or summary prospectus, which includes investment objectives, risks, fees, expenses and other information that you should read and consider carefully before investing. In addition to the normal risks associated with investing, international investments and commodity related instruments may involve risk of capital loss from unfavorable fluctuation in currency values, from differences in generally accepted accounting principles, or from economic or political instability in other nations. Emerging markets involve heightened risks related to the same factors, as well as increased volatility and lower trading volume.

Investing Strategy Disclosure

SMS Investing® utilizes extensive back testing in an attempt to validate that a given strategy will work over time; however, the investor should be aware that certain challenges exist which may result in an investor not not receiving the same or similar returns that the back test or model portfolio indicates. Timing of transactions,  sales fees, broker fees, and unique market conditions may result in individual investors under/over performance compared to back tests and published model portfolios. Additionally, the author makes no guarantees that a given investing strategy will continue to perform.

Investing Policy

The author(s) will disclose their recommendation or ownership until he ceases to recommend the stock, or sells his entire position. We will always disclose whether the author has an interest in the stocks, bonds, or funds mentioned. Members of SMS Investing® may participate in an investing strategy and execute its trading recommendations without restriction as to public notification.

Personal Interest Disclosure

  • When a writer writes about in individual stock that he or she has a position or beneficial interest in, that fact is disclosed at the end of the article.
  • In compliance with Section 17(b) of the Securities Act of 1933 (15 U.S.C. 77q(b)), SMS Investing® has established a policy to refuse "a consideration received or to be received, directly or indirectly, from an issuer, underwriter or dealer" in return for reviews or recommendations, either favorable or unfavorable.

Trading Restrictions

In addition to the above disclosure requirements, SMS Investing® works under additional trading restrictions and guidelines. These restrictions require that they:

  • Must wait until after receiving the publicly broadcast-ed notification of a given investing strategy before executing any trades recommended by a given SMS Investing® mechanical strategy, or stock recommendation.

Not a Registered Investment Adviser

This site operates under the provisions under Section 401(f) of the Uniform Securities act which states: "a publisher of any bona fide newspaper, news column, newsletter, news magazine, or business or financial publication or service, whether communicated in hard copy form, or by electronic means, or otherwise, that does not consist of the rendering of advice on the basis of the specific investment situation of each client" is excluded from the definition of an investment adviser. As such SMS Investing® can only offer "situational" advice in broad terms published to its general audience. SMS Investing® does not manage or exercise discretion in clients personal investing accounts. Additionally, we do not receive compensation for our advice, therefore we are not an investment adviser.

Not a Broker/Dealer

SMS Investing® is not a Broker/Dealer and does not effect transactions on behalf of any client's personal investing accounts.

Many of these companies are public companies operating in industries that we follow.
